Apr.9 (GMM) Max Mosley intends to donate any damages from his legal pursuit of the British newspaper News of the World to the FIA Foundation, his lawyers revealed on Wednesday.

Despite losing an injunction to suppress a short video edit of the FIA president's recent orgy with prostitutes, his law firm Steeles Law presented to the London High Court proceedings against News of the World's parent company, News Group Newspapers Limited.

Mosley is seeking unlimited damages, but vowed to donate the potential damages to the FIA Foundation, which promotes road and motor racing safety and the environment.

Although Wednesday's hearing did not involve the contested allegation of Nazism, Mr Justice David Eady suggested that News of the World might face difficulty defending this claim at the forthcoming five day trial.

He said the argument that Mosley's actions amounted to a 'depraved Nazi sadomasochistic orgy' is "certainly ... very weak", and that "it may be the court will in due course hold that there is nothing in the allegations of Nazi role-play".

News of the World's legal spokesman Tom Crone on Wednesday said the newspaper stands by its Nazi contention.

He said Eady was able to see only "very brief extracts" of the full orgy video, insisting that "had he seen it in its entirety, we are confident that he could not fail to recognise the Nazi connotation which Mr Mosley so strenuously denies."
